ആസിഫ് അലിയുടെ നിയമനത്തിന് സ്‌റ്റേ

കൊച്ചി: ആസിഫ് അലിയെ ഡയറക്ടര്‍ ജനറല്‍ ഓഫ് പ്രോസിക്യൂഷന്‍ (ഡിജിപി) നിയമിച്ച സര്‍ക്കാര്‍ തീരുമാനം ഹൈക്കോടതി സ്‌റ്റേ ചെയ്തു. നിയമനത്തിന് ചീഫ് ജസ്റ്റീസിന്റെ അനുമതിയില്ലെന്ന പരാതിയെ തുടര്‍ന്നാണ് സ്‌റ്റേ.

ഹൈക്കോടതി അഭിഭാഷകനായ ആസിഫ് അലിയെ ഡിജിപിയായി നിയമിച്ചത് വിവാദമായിരുന്നു. ആസിഫ് അലിക്ക് ഹൈക്കോടതിയില്‍ വേണ്ടത്ര പ്രാക്ടീസ് ഇല്ലെന്നു കാണിച്ച് ഹൈക്കോടതിയിലെ ഒരു അഭിഭാഷകന്‍ തന്നെയാണ് ഹര്‍ജി സമര്‍പ്പിച്ചത്.

ഒരു പ്ലീഡര്‍ ആകുന്നതിനു പോലും യോഗ്യതയില്ലാത്ത ആസിഫ് അലിയെ ചട്ടങ്ങള്‍ മറികടന്നാണ് ഡിജിപിയായി നിയമിച്ചതെന്ന് ഹര്‍ജിക്കാരന്‍ കോടതിയെ അറിയിച്ചു. നിയമനത്തിന് ചീഫ് ജസ്റ്റീസിന്റെ അനുമതി ലഭിച്ചിരുന്നില്ല. അഡ്വക്കേറ്റ്‌സ് ജനറല്‍ ഓഫ് പ്രോസിക്യൂഷന്‍ ഭരണപരമായ പദവിയാണെന്നും ഇത്തരമൊരു പദവിയിലേയ്ക്ക് നിയമനം നടത്തുന്നതിന് ചീഫ് ജസ്റ്റിസിന്റെ അനുമതി വേണ്ടന്നാണ് സര്‍ക്കാര്‍ വാദിച്ചത്.

The Kerala High Court on Thursday stayed temporarily the appointment of Adv T Asif Ali as the Director General of Prosecutions (DGP). The action follows the petition filed by Adv EA Thankappan alleging that the appointment was made flouting the guidelines. A rule states that appointment of a person to the post of director general of prosecutions must have 7 years of practice as an advocate. But there is no strict rule saying that the practice must be in the HC itself. Asif Ali has been practicing in Thalassery, Kasargod and Mahe. A petition also pointed out a rule that the chief justice must recognize the appointment and that too was not adhered to.
